Trump Secures A Major Legal Win In $20 Billion Defamation Case Against CBS News [WATCH]

Kacsmaryk rejected the motion to dismiss, which was filed by CBS and Paramount, ruling that the companies’ request was moot due to the amended complaint.. “Plaintiffs add a Defendant, a Plaintiff, and a litany of factual allegations and legal claims in their Amended Complaint. Accordingly, the Motions are denied as moot,” Kacsmaryk wrote in a court filing obtained by Fox News Digital.. CBS had argued that Texas was an improper venue for the lawsuit and had sought to have the case transferred to New York.. Kacsmaryk’s decision means the case will remain in Texas for now.. CBS and Paramount have 21 days to re-file their motion to dismiss based on the updated lawsuit.. Kacsmaryk clarified that his ruling does not weigh in on the merits of the case, stating:. “Nothing in this Order shall be construed as a determination on the merits of either Plaintiffs’ or Defendants’ substantive arguments and claims in the Motions or Amended Complaint.”. CBS News has not yet commented on the ruling.. The lawsuit is unfolding as CBS faces mounting scrutiny over its handling of Harris’ interview.. Last week, the Federal Communications Commission (FCC) released the raw transcript and footage, revealing that CBS aired two different versions of Harris’ response to “60 Minutes” correspondent Bill Whitaker’s question about Israeli Prime Minister Benjamin Netanyahu’s response to the Biden-Harris administration.. In a preview clip aired on “Face the Nation,” Harris’ full response was broadcast:. “Well, Bill, the work that we have done has resulted in a number of movements in that region by Israel that were very much prompted by, or a result of many things, including our advocacy for what needs to happen in the region.
