DOJ Labels Judge’s DOGE Treasury Order ‘Anti-Constitutional,’ Ask Court To Lift Order

The recently established Justice Department in President Donald Trump’s administration labeled a judge’s recent ruling concerning the Department of Government Efficiency (DOGE) as “anti-constitutional,” particularly in relation to obtaining funding information from the Treasury Department. On Monday, the Department of Justice stated that a federal judge’s decision to prevent Elon Musk and his associates from accessing Treasury Department information is “unconstitutional.” They have now submitted a court order to either “dissolve” or “modify/clarify” the ruling. “There is no basis, and it is impossible to differentiate between ‘civil servants’ and ‘political appointees.'” According to DOJ attorneys, basic democratic accountability necessitates that each executive agency’s operations be overseen by leadership that is politically accountable and ultimately responsible to the President. Stephen Miller, the Deputy White House Chief of Staff, addressed this topic on FOX’s “Sunday Morning Futures” show. He expressed concerns about “rogue bureaucrats” who are unelected and accountable to no one, holding positions with lifetime tenure that supposedly makes them untouchable, which he argued is a misconception. He noted that power has been consolidated over the years among bureaucrats in various agencies, creating an unelected force that influences government operations. Meanwhile, U.S. District Judge Paul Engelmayer has issued an order that limits access to the department’s payment systems and other data for all political appointees, special government employees, and those detailed from agencies outside the Treasury Department. Despite the Trump administration’s Department of Justice claiming they have “substantially complied” with the directive, they have also characterized it as “anti-constitutional.”
